[ I have written a series of posts about the "pay the storm" bugaboos. I call it "The Stormpuke--Stormpay Story: Getting to the Heart of the Matter in Posts" . You can get it here. This nightmare is ongoing with no end in site. ]
Now an interesting twist has come about in nightmare land. The state of North Carolina has "issued" a cease and desist order against 12dailypro. Before I go any further, let's define what this "cease and desist" stuff is. The following I found on a law website:
**** cease and desist ****
Cease-and-desist order: an order issued by a bank regulatory agency, or any agency authorized to do so by law. In the United States, such orders are issued by regulatory agencies that fall under the Financial Institutions Regulatory Act of 1978. A cease-and desist order is a very serious document.
The order includes the notice for the opportunity of a hearing, and requires the offending party (financial institution, corporation, responsible individual) to suspend any unlawful, unsafe, or unsound practices. A cease-and desist order is enforceable in a court of law.
Some states and countries have laws that allow an individual to issue a cease-and-desist to stop harassment, stalking, or other behavior that is injurious in some legal way to the issuing party. The appropriate statute must be declared in the text of the order, and the order must be delivered by marshal or registered mail, return receipt requested. Evidence of the issuance should be stored with a third party, preferably the attorney or legal counsel whose advice has been sought about the issuance.
**** end of cease and desist ****
I could not find no such announcement against 12dailypro on the north carolina gov site, much less the "documented" order. Oh wait, that is not even the END of it. I am hearing from a few people in the state of Utah about how those who have made complaints against stormpay in that state are being thrown in jail. Nice. So much for the "law" protecting the innocent and "free speech".
A reader sent me some amusing information about stormpuke being a money collector for the government freaks in Tennessee. This information is as follows:
**** stormpay license ****
StormPay License Up For Renewal
I am offering this on my own, and independently of anything that is going on between StormPay and any other parties.
SP's license as a money transmitter with the Tennesse Department of Financial Insitutions is due to expire on April 15.
http://www.tennessee.gov/tdfi/compliance/Lic_MT.html#S
LICENSE # 95
STORMPAY, INC
1690 GOLF CLUB LANE
CLARKSVILLE, TN 37043
EXPIRATION DATE: 04/15/2006
If SP intended to renew their license this year , they had to submit a financial statement to the Commissioner on Jan.15 ( does the timing seem suspect?)
(b) The license renewal fee shall be paid by April 15 of each year, and be accompanied by a report, in a form approved by the commissioner, which form shall be sent by the commissioner annually to each licensee no later than January 15. The licensee must include in its annual renewal report:
(1) A copy of its most recent audited unconsolidated annual financial statement (including balance sheet, statement of income or loss, statement of changes in shareholder's equity and statement of changes in financial position), except that a licensee may provide the most recent audited consolidated annual financial statement of the parent corporation if such statement includes the balance sheet, statement of income or loss, statement of changes in shareholder's equity and statement of changes of financial position of the licensee.
(2) A licensee that has not filed a renewal report or paid its renewal fee by April 15 of each year, and has
not been granted a written extension signed by the Commissioner, shall be notified by the
Commissioner that a hearing will be scheduled at which time the licensee must show cause why its
license should not be suspended pending compliance. In addition, the commissioner may provide in
the Notice of Hearing that civil penalties may be assessed for each day that the renewal report or
renewal fee is late.
Authority: T.C.A. ยงยง 45-7-211, 45-7-226; and 45-7-223. Administrative History: Original rule filed September 15,
1996; effective January 28, 1996.
This is a copy of the License Renewal form:
http://www.tennessee.gov/tdfi/forms/MT2006Renewal.pdf
From Tennessee Code Title 47, Chapter 7, 211, on what needs to be included with a renewal application:
(6) Notification of material litigation or litigation relating to money transmission;
(7) Such other information as the commissioner may deem appropriate for the proper enforcement of this part.
There may not, to this point, be litigation, but I believe the commissioner would find our current situation of interest.
My suggestion: If you feel you have been harmed by SP's actions, file a complaint with the Tennessee Department of Financial Insitutions:
http://www.tennessee.gov/tdfi/crd/crcontacts.html
I have already contacted them, and Kayce Stoker replied that the quickest way to have your complaint get to them would be to file using the online form, and then either fax, or mail, your documentation.
This is something we can do on our own behalf, without resorting to attorneys.
**** end of stormpay license ****
I would not recommend anyone take any legal action without consulting an attorney first. And speaking of attorney's the lawyer in Texas that was going to get Stormpay under the RICO act was exposed as a fraud at www.surfstop.zoomshare.com. So that's another horrible thing people have to worry about when getting a lawyer. Do a background check on them first before hiring them. There are crooks everywhere. Money talks and bullshit walks. Speaking of total bullshit, some people are reporting that stormpuke is bribing those who have had their accounts suspended by them, that the only way to get their money back from stormpuke is to write a glowing review about them on the Amazon site. Do we need to wonder why Amazon has been dubbed as the "swamp that accepts any type of shit as long as they're able to keep the stockholders happy on wallstreet."?
When it comes to corporate wars, nothing is more scary than when customers decide to take matters into their own hands and "to hell with the law" as I am hearing from more and more outraged victims. Is dum-dum in chief bush finding another way of instigating a civil war in this country via stormpuke to justify the permanent renewal of the patriot act? This nightmare with stormpuke has gone on since their pathetic existence in 2002/2003, and then turned into an all out war at the end of January 2006 by picking on 12dailypro, which coincidentally the owner is a christian.
The war has always been the new world order vs the christians with everyone else stuck in the middle of the crossfire, being forced to choose sides. Is it possible that the whole storm could backfire on the new world order freaks? The answer by default is yes. When will it backfire? Time will only tell. Besides, the story doesn't end here. Stories really never have an ending to them. They just continue on and on like a circle.
