[ I have written a series of posts about the "pay the storm" bugaboos. I call it "The Stormpuke--Stormpay Story: Getting to the Heart of the Matter in Posts" . You can get it here. This nightmare is ongoing with no end in site. ]
I don't know how many people have taken stormpuke to court so far, but this recent story is very interesting. It was picked up from http://hurricanesp.blogspot.com/ who picked it up from some forum on talk gold. The story is as follows [my rude comments follow afterwards]:
**** story ****
Account holder meets Storm Pay in court.
Well, it's seems as though someone managed to get Storm Pay into court. A member of Talk Gold makes a post the experience in forums:
Hearing in Clarksville: No News 'Till July
Sorry to report that it was less than a satisfying day in court in Clarksville. While I showed up ready to try a case, it didn't work out that way. Here's the way it broke down.
First of all, Girsky showed up to represent Stormpay. He was accompanied by John McConnell, Jr. (Incidentally, I talked with McConnell for serveral minutes. He was affable, intelligent, and a good conversationalist. I liked him a lot. Girsky was Girsky.) I don't think Girsky was very well prepared.
He apparently came in with the idea that he could get the thing dismissed immediately based on the order from the federal court in L.A. It didn't work out for him.
The judge ordered all parties to confer regarding the possibility of settlement. Girsky hit me with the SEC order, telling me I was violating it. I told him I didn't think so. I indicated I was willing to let the judge make the decision on that, and was prepared to argue the thing right then. He didn't choose to. He moved on to threatening to countersue me, saying I "have a lot to answer for." I said, "Okay. Sue me." He informed me it's on the way.
Things sort of went downhill from there. I have to admit I was at a total loss as to how to deal with him. I was charming. I was witty. I displayed a sense of empathy for him. I expressed concern for the value of his time, and offered to present and argue a motion today, so he wouldn't have to take the time to respond to a written motion. My concern left him unmoved.
He said he'd oppose everything in writing. Despite my best efforts, nothing seemed to bring him around. I can only say, dear friends, that his behavior forced me to one conclusion: I don't think the man liked me. Despite my best efforts, I failed as Mr. Congeniality. And I was trying so hard. I guess it's a character flaw in me.
The upshot of the whole thing is that we're still on the docket. We couldn't agree on a settlement. It's set for trial on July 10. I thought that was a little long, but Girsky got to pick the date. He's a lawyer, you know, and his time has great value. That's the bad news. The good news is, we're still on the docket, and we have plenty of time to prepare before July 10. I can live with it if he can.
He did have one small victory, though. I have a friend who filed a similar suit, and he agreed to dismiss his. He's 70 years old, and didn't want to drive down to Clarksville again. He decided it wasn't worth the time and trouble. I, on the other hand, have plenty of time and don't mind the driving. So, as I said to Girsky when we parted, "See you in July."
**** end of story ****
Ok I don't know where to start with it, as there are several things wrong with the story. Let's start with the fact that Mr. Grinchky [Steve Girsky. I call him Mr. Grinchky after hearing someone make fun out of his name from another forum] was representing stormpuke in court. Him and Mc'ConDELL [you can figure out the mockery behind that] are "supposedly" the CEO and Veep [which they are not as I have stated several times throughout this ongoing nightmare. They are just managers managing the storm, but anyway] and yet Grinchky was playing the part of the lawyer. Now I can't say for sure if his lawyer credentials are legit or not. Some researchers say they are not because he can't be found at any of the state law sites. Nice.
I am [well not, but anyway] surprised that the judge didn't throw Mr. Grinchky out of the court room and insist that stormpuke find another lawyer to represent them. It's called a conflict of interest. Whether the judge saw that or realized it, I don't know. The judge was probably paid off, as apparently the judge wasn't even WILLING to decide who was right and who was wrong. If that wasn't bad enough, Mr. Grinchky wasn't even willing to listen to ANY type of settlement.
Stormpuke has made it clear again and again that they WILL NOT pay the money they stoled back. They would rather be sitting in jail than to give the money back. They would rather get the electric chair than to give the money back. I know it's sounds unreal, but that's what the WHOLE situation is. UNREAL. I never imagined that I would still be writing about stormpuke, much less have already 3 dozen posts about the thugaboos. How long will this nightmare drag on? I say at least until the end of the year. I probably will have 100 posts by then. Enough to make a book. That would be nice to have a book out on the market of the aftermath. Maybe then I can make a few buckaroos. I don't know what I would do with all the money. Probably just sit on it until I can think of how to spend it. I probably would be sitting on it for a while though. I always do that every time a little bit of money crosses the palm of my hand. Simply because I don't know what tomorrow is going to bring. One day, tomorrow will never come. I don't know what I would do then. Probably cry.
